Firm Partner Tom FitzGibbon assisted a publicly traded company in defending against federal court litigation brought by MySpace, Inc. arising out of the client’s marketing campaign. MySpace sought hundreds of millions of dollars in damages from the client for a variety of claims, including those based on the CAN-SPAM Act, trademark infringement and California statutes concerning electronic messaging. The matter was successfully resolved through a confidential settlement after a mediation at JAMS before neutral Jeff Kichaven.
