Partner Tom FitzGibbon recently achieved a favorable settlement for a client whose property was damaged by a landslide caused by a developer’s negligence in maintaining erosion control measures on a $100 million development project. The case involved relief from a bankruptcy stay and technical discovery and the use of experts, including regarding mold. The matter was resolved through mediation with George Calkins at JAMS.
